Distance Sales Contract

1. PARTIES

By accepting this Contract, the BUYER acknowledges that they will be obligated to pay the order amount, including shipping fees, taxes, and any additional charges, upon confirming the order.

2. DEFINITIONS
   For the implementation and interpretation of this Contract, the following terms shall have the meanings ascribed below:

• MINISTRY: Refers to the Ministry of Customs and Trade.
• LAW: Refers to Law No. 6502 on the Protection of Consumers.
• REGULATION: Refers to the Regulation on Distance Contracts.
• SERVICE: Any consumer transaction, other than the supply of goods, performed or promised to be performed in return for a fee or benefit.
• SELLER: The company offering goods to consumers within the scope of its commercial or professional activities, or acting on behalf of or for the account of the supplier.
• BUYER: A natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes.
• SITE: The Seller’s website.
• ORDERING PARTY: The natural or legal person requesting a good or service via the Seller’s website.
• PARTIES: The Seller and the Buyer.
• CONTRACT: This agreement between the Seller and the Buyer.
• GOOD(S): The movable item(s) subject to purchase, including intangible goods such as software, audio, video, and similar digital products.

3. SUBJECT MATTER This Contract regulates the rights and obligations of the Parties regarding the sale and delivery of the product(s) ordered by the Buyer via the Seller’s website, in accordance with Law No. 6502 and the Regulation on Distance Contracts.
The prices listed and advertised on the site are the selling prices. Advertised prices and promotions remain valid until updated or modified. Time-limited prices are valid only until the specified deadline.

9. GENERAL PROVISIONS
   9.1 Acknowledgment and Acceptance
   The Buyer declares and undertakes that they have read the essential features of the product, sale price, payment method, and delivery terms on the Seller’s website and confirmed their consent electronically.

9.2. Delivery Period
Each product subject to this Contract shall be delivered within the timeframe specified on the website, not exceeding the legal 30-day period, depending on the Buyer’s location.

10. RIGHT OF WITHDRAWAL
    The Buyer has the right to withdraw from the contract within 14 days of receiving the product (or its delivery to a designated third party) without providing any justification, provided they notify the Seller.
11. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
    The right of withdrawal does not apply to:
    • Custom-made or personalized products.
    • Underwear, cosmetics, and disposable products.
12. DEFAULT AND LEGAL CONSEQUENCES
    If the Buyer defaults on payment (e.g., credit card transactions), they acknowledge that they will be liable for interest and penalties under their agreement with the issuing bank.
13. COMPETENT COURT
    Disputes arising from this Contract shall be resolved before the Consumer Arbitration Committees or Consumer Courts in the jurisdiction of the Buyer’s residence or where the transaction took place.
14. EFFECTIVENESS
    The Buyer shall be deemed to have accepted all terms of this Contract upon completing payment for the order.
